The Draft Convention on the Recognition of Judicial Sale of Ships

There have been many years of problems related to recognition of court judgments of a state where a ship was arrested and sold by another state (among other things, but not limited to, by the state where the ship, with all rights, encumbrances thereupon, was registered before her forced sale). Yet the issues remained unregulated.

Several years ago, the International Maritime Committee submitted a proposal for work on an international instrument covering and settling the problematic issues. The respective instrument – draft convention on the recognition of judicial sale of ships – has gotten the name of the Beijing Draft.

The conference was held on October 4, 2019 and brought together representatives of major airlines, leading educational institutions, government organizations, experts and lawyers in air law.

Analysis of legal developments in the international airline industry during 2017

On 21 August 2017 the Montreal Convention for the Unification of Certain Rules for International Carriage by Air dated 28 May 1999 (the "Montreal Convention") came into legal force for the Russian Federation. The Montreal Convention, however, does not apply to (a) internal air carriage performed by Russia for non-commercial purposes in connection with the exercise of its functions and duties as a sovereign state, and (b) carriage of persons, cargo and baggage carried out for the military authorities on aircraft registered in or leased by Russia that are fully reserved by, or on behalf of, these authorities. Electronic signatures: are they valid and enforceable in Russia?

Are electronic signatures legally valid?

The following categories of electronic signature are recognised:

(1) Simple
(2) Enhanced encrypted and non-certified
(3) Enhanced encrypted and certified

Electronic signatures falling into category (3) ('enhanced encrypted and certified') are deemed to have value equal to a handwritten signature unless a specific law applicable to the particular document requires execution in paper form.

However, parties to a contract are free to agree that electronic signatures falling into categories (1) and (2) above shall be treated as valid and have equal status as a handwritten signature. Learn more →

The authors outline the process of formation of the European law, its evolution and modern structure. 24 October 2018. The Institute of Legislation and Comparative Law under the Government of the Russian Federation organized international conference – XIII Annual Scientific Lectures in memory of Sergey Bratus: "Contract as a social value".

The parties are free to determine the time when the title passes from the shipbuilder to the shipowner. Under the Civil Code, unless otherwise provided by the contract, the risk of incidental loss of the new building passes from the shipbuilder to the shipowner at the time of acceptance.
2. Are there any remedies available in local courts to compel delivery of the vessel when the yard refuses to do so?
The shipowner may file a claim to oblige the yard to deliver the vessel. If the claim is granted by the court, it may be enforced with the assistance of bailiffs. In addition, the yard may be obliged to pay damages incurred as a result of unlawful detention of the vessel. Learn more →
